OVERVIEW

Welcome to TFM Perfumes. The terms "we", "us" and "our" refer to TFM Perfumes Company W.L.L. (شركة تي اف ام للعطور ذ.م.م), a limited liability company incorporated and registered under the Kuwait Companies Law No. 1 of 2016 and the Kuwait Commerce Law No. 68 of 1980, holding Commercial Registration No. 416561 and License No. 2019/29123.

TFM Perfumes operates this online store and website to provide you with products and services (the "Services"). By using the Services, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy, in accordance with the applicable laws of the State of Kuwait.

SECTION 1 – LEGAL FRAMEWORK

These Terms are governed by and shall be interpreted in accordance with:

  • Kuwait Commerce Law No. 68 of 1980 (القانون التجاري)
  • Kuwait Companies Law No. 1 of 2016 (قانون الشركات)
  • Kuwait Consumer Protection Law No. 39 of 2014 (قانون حماية المستهلك)
  • Kuwait Civil Code No. 67 of 1980 (القانون المدني)
  • Kuwait Commercial Licensing Law No. 111 of 2013 (قانون ترخيص المحلات التجارية)
  • Kuwait Electronic Transactions Law No. 20 of 2014 (قانون المعاملات الإلكترونية)

SECTION 2 – ACCESS AND ACCOUNT

By using the Services, you represent that you are at least 21 years of age (the age of civil majority under Article 96 of the Kuwait Civil Code). Minors may use the Services only under the supervision and consent of a parent or legal guardian.

You are responsible for maintaining the confidentiality of your account credentials. You may not transfer, sell, or assign your account to another person.

SECTION 3 – OUR PRODUCTS

TFM Perfumes is licensed for the retail and wholesale of perfumes, cosmetics, decorative soaps, incense, and import of chemical materials (Activity Codes: 477230, 461033, 464952).

In accordance with Article 8 of the Consumer Protection Law No. 39 of 2014, we ensure that all product descriptions, prices, and information displayed are accurate and not misleading. Product images may vary slightly due to screen settings. All products sold comply with applicable Kuwait standards and regulations.

SECTION 4 – ORDERS AND CONTRACTS

In accordance with the Kuwait Electronic Transactions Law No. 20 of 2014, placing an order through our website constitutes a binding electronic contract once accepted by TFM Perfumes. Your order is not accepted until we send confirmation.

Under Article 5 of the Consumer Protection Law, you have the right to receive clear information about the product, its price, and terms of sale before completing your purchase.

We reserve the right to decline any order at our discretion. If we cancel an order, we will notify you and issue a full refund.

SECTION 5 – PRICES AND BILLING

All prices are listed in Kuwaiti Dinars (KWD). In compliance with the Consumer Protection Law, all prices displayed are final and inclusive of applicable charges unless otherwise stated. Shipping fees and any customs charges for international orders will be clearly shown at checkout before payment.

Prices are subject to change without prior notice. The price charged will be the price at the time your order is placed.

SECTION 6 – PAYMENT METHODS

We accept: KNET, Visa, Mastercard, Apple Pay, and Cash on Delivery (COD) where available. All electronic payments are processed through secure, PCI-compliant payment gateways in accordance with the Kuwait Electronic Transactions Law. We do not store your full payment card details.

SECTION 7 – CONSUMER RIGHTS

In accordance with the Kuwait Consumer Protection Law No. 39 of 2014, you have the following rights:

  • The right to receive products that are safe, free from defects, and fit for their intended purpose.
  • The right to accurate and truthful information about products and prices.
  • The right to return defective products and receive a replacement or full refund.
  • The right to file complaints with the Ministry of Commerce and Industry – Consumer Protection Department (إدارة حماية المستهلك) if your rights are violated.
  • The right to compensation for damages caused by defective products under Article 11 of the Consumer Protection Law.

SECTION 8 – WARRANTY

Under Articles 488-492 of the Kuwait Commerce Law and Articles 559-578 of the Kuwait Civil Code (Warranty Against Defects), all products sold by TFM Perfumes carry an implied warranty against hidden defects. If a product is found to have a hidden defect that was not apparent at the time of purchase, you have the right to return it for a full refund or replacement.

SECTION 9 – SHIPPING AND DELIVERY

Delivery within Kuwait: 2-5 business days. International (GCC): 5-14 business days. All delivery times are estimates. We are not liable for delays caused by carriers, customs, or force majeure events as defined under Article 215 of the Kuwait Civil Code.

Risk of loss passes to the buyer upon delivery to the carrier, in accordance with Article 520 of the Kuwait Commerce Law.

SECTION 10 – INTELLECTUAL PROPERTY

All trademarks, logos, content, images, and product descriptions on the Services are the property of TFM Perfumes Company W.L.L. and are protected under Kuwait Trademark Law No. 68 of 1980 (Part 3) and Kuwait Copyright Law No. 64 of 1999. Unauthorized use, reproduction, or distribution is strictly prohibited and may result in legal action.

SECTION 11 – RELATIONSHIP WITH SHOPIFY

TFM Perfumes is powered by Shopify. All sales are made directly with TFM Perfumes Company W.L.L. Shopify is not a party to any transaction and is not responsible for products, services, or disputes. You release Shopify from all claims arising from your transactions with us.

SECTION 12 – PRIVACY AND DATA PROTECTION

We collect and process personal data in accordance with applicable Kuwait laws and our Privacy Policy. Under the Kuwait Constitution (Article 39), communications and correspondence are protected. We will not disclose your personal information to third parties except as required by law or with your consent.

SECTION 13 – PROHIBITED USES

You may not: (a) use the Services for unlawful purposes under Kuwait law; (b) infringe intellectual property rights; (c) harass or harm any person; (d) transmit false information; (e) use automated tools to access the Services; (f) attempt to circumvent security measures. Violations may result in account suspension and legal action under applicable Kuwait law.

SECTION 14 – LIMITATION OF LIABILITY

To the extent permitted under the Kuwait Civil Code, TFM Perfumes' total liability for any claim shall not exceed the total amount paid by you for the specific order giving rise to the claim. We shall not be liable for indirect, incidental, or consequential damages. Nothing in these Terms excludes liability that cannot be excluded under Kuwait law, including liability for fraud or willful misconduct.

SECTION 15 – FORCE MAJEURE

In accordance with Article 215 of the Kuwait Civil Code, TFM Perfumes shall not be liable for failure or delay in performing obligations due to events beyond our reasonable control, including but not limited to natural disasters, war, government actions, epidemics, supply chain disruptions, or interruption of communication systems.

SECTION 16 – DISPUTE RESOLUTION

Any dispute arising from these Terms shall first be attempted to be resolved amicably. If not resolved, disputes shall be referred to the competent courts of the State of Kuwait, which shall have exclusive jurisdiction. Consumers may also file complaints with the Consumer Protection Department at the Ministry of Commerce and Industry.

SECTION 17 – SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable under Kuwait law, the remaining provisions shall continue in full force and effect.

SECTION 18 – CHANGES TO TERMS

We reserve the right to update these Terms at any time. Material changes will be communicated in accordance with applicable law. Your continued use of the Services constitutes acceptance of any changes.
